Range Report Pro — Shooting Log and Analytics App
Please read these Terms and Conditions ("Terms") carefully before using the Range Report Pro mobile application ("the App," "we," "our," or "us"). By downloading, installing, or using the App, you agree to be bound by these Terms. If you do not agree, do not use the App.
Range Report Pro is a shooting range session logging application for Android and iOS. It allows users to record shooting sessions, track statistics and trends, set maintenance reminders, and receive optional shot-diagnosis feedback through an on-device "AI Coach" feature. The App does not require an account or login. All data is stored locally on the user's device, and, by default, is also automatically backed up periodically to the user's own personal iCloud or Google account; users can also trigger a manual backup at any time, and can disable automatic backup in the App's Settings (see Section 4).
Shooting sports carry inherent risks. Your use of the App has no bearing on, and does not mitigate, any risks associated with the actual handling and discharge of firearms. You use firearms and participate in shooting activities entirely at your own risk and discretion, independent of this App.
Range Report Pro stores all data locally on your device, with no account system. By default, the App also automatically creates periodic backups of your data directly to your own iCloud (iOS) or Google (Android) account, and you may also trigger a manual backup at any time. Backups, whether automatic or manual, are sent directly to the cloud account you are signed into and are never sent to us or any server we operate. You may disable automatic backup at any time in the App's Settings.
While we aim for the App's statistics, trend calculations, and "AI Coach" feedback to be useful and accurate, we make no guarantees regarding the accuracy, completeness, or reliability of any data, calculation, or suggestion generated by the App. You should use your own judgment when interpreting any information the App provides.
You agree to use the App only for lawful purposes. You agree not to:
The App, including its design, branding, logo, features, and underlying code, is owned by Othmar Gispert and is protected by applicable intellectual property laws. These Terms do not grant you any rights to our trademarks, logos, or branding.
The App is provided "AS IS" and "AS AVAILABLE," without warranties of any kind, whether express or implied, including but not limited to implied warranties of merchantability, fitness for a particular purpose, or non-infringement. We do not warrant that the App, including its optional cloud backup feature, will be uninterrupted, error-free, or free of harmful components.
To the fullest extent permitted by law, Othmar Gispert shall not be liable for any indirect, incidental, special, consequential, or punitive damages, or any loss of data, profits, or goodwill, arising out of or related to your use of, or inability to use, the App — including, without limitation, any damages related to firearm handling, range activity, reliance on any statistic, score, or suggestion generated by the App, or use of the optional cloud backup feature and any issue arising from Apple's or Google's services.
We may update, modify, or discontinue the App (or any feature within it, including the optional cloud backup feature) at any time without notice. We may also revise these Terms from time to time; continued use of the App after changes are posted constitutes your acceptance of the revised Terms. We will update the "Last Updated" date above when changes are made.
We reserve the right to discontinue your access to the App at our discretion, for example if you violate these Terms. Since the App requires no account, "termination" generally means restricting future updates or support rather than deleting any account or data (as none is held by us).
These Terms shall be governed by the laws of the State of Texas, without regard to its conflict of law provisions.
Range Report Pro is made available through the Apple App Store and Google Play. The following additional terms apply when the App is obtained through Apple's App Store, and reflect the provisions Apple requires in its Licensed Application End User License Agreement:
These Terms are entered into between you and Othmar Gispert ("Application Provider") only, and not with Apple Inc. ("Apple"). Othmar Gispert, not Apple, is solely responsible for the App and its content.
The license granted to you for the App is limited to a non-transferable license to use the App on any Apple-branded device that you own or control, as permitted by the App Store's Usage Rules.
Othmar Gispert, not Apple, is solely responsible for providing any maintenance and support services with respect to the App, to the extent required under applicable law. Apple has no obligation whatsoever to furnish any maintenance or support services for the App.
In the event of any failure of the App to conform to any applicable warranty, you may notify Apple, and Apple will refund the purchase price (if any) for the App to you. To the maximum extent permitted by applicable law, Apple has no other warranty obligation whatsoever with respect to the App, and any other claims, losses, liabilities, damages, costs, or expenses attributable to any failure to conform to any warranty will be Othmar Gispert's sole responsibility.
Othmar Gispert, not Apple, is responsible for addressing any claims relating to the App, including: (i) product liability claims; (ii) any claim that the App fails to conform to any applicable legal or regulatory requirement; and (iii) claims arising under consumer protection, privacy, or similar legislation, including in connection with the App's firearms-related content, "AI Coach" feature, and optional cloud backup feature.
In the event of any third-party claim that the App, or your possession and use of the App, infringes that third party's intellectual property rights, Othmar Gispert, not Apple, will be solely responsible for the investigation, defense, settlement, and discharge of any such claim.
You represent and warrant that you are not located in a country subject to a U.S. Government embargo or designated by the U.S. Government as a "terrorist supporting" country, and that you are not listed on any U.S. Government list of prohibited or restricted parties.
Apple, and Apple's subsidiaries, are third-party beneficiaries of these Terms. Upon your acceptance of these Terms, Apple will have the right (and will be deemed to have accepted the right) to enforce these Terms against you as a third-party beneficiary.
